NOTES

Mitchell B. UMPHRESS died intestate (without a will), appointed Joshua TAYLOR as Administrator. Of course at that time, women didn’t have the rights they have now either.

I found a petition for Dower, Sale of Real Estate and report of Commission on page 278…book dated June 14, 1845 thru July 24, 1872. This was the document that gave the best estimation of Mitchell B. UMPHRESS’ death. The document (like all old records) are very hard to read but it stated, “To the honorable Judge of Probate of Jefferson Co., Florida, your petitioner, Joshua TAYLOR respectfully represents unto your honorable court that he is the legal representative of the estate of Mitchell B. UMPHRESS, late of said county, who died intestate leaving a widow and several small children. That he applied to your honorable court on the 9th day of April, 1859.  This document lists the land…a total of about 280 acres.

I also checked the land records and I’ll get into those in a bit but the other date I found was contained in the Grantor books that shows that Mitchell B. UMPHRESS borrowed $250 on 1-1-1858 from Budd William to be paid within 12 months at 8% interest. He gave 39 89/100 acres as collateral. This is recorded in WD Book H, page 411 and was recorded on 3-25-1858. ***You will see later where a payment was made concerning this debt at a later date.

From the above two documents we can determine that Mitchell died 4-9-1859.

The bulk of his land was sold to Sarah Ann HAMILTON as recorded in the WD Book I page 563. The price stated for 275 1/3 acres was $2,786.

After Mitchell died, his estate was still paying taxes on land in Georgia. One of the reports stated that Martha UMPHRIES, as dower, received $200.00 for the land sold in Carroll County Georgia. The census index where Benjamin UMPHRESS was listed on the 1820 Irwin County Census and in 1830 was in Carroll County Georgia.

In the disbursements they listed each voucher and the amount and who they were to. The children were educated by a tutor; many doctor bills and for food and dry goods.  It appears they were paid to Dr. PULLEN and said they were for Artimissie, John, Arphaxad, Peyton and Erastus. None of the amounts were very much…just a few dollars. Other names on the list were J.N. SUMMERS, MARVINS, McINTOSH, J.S. DEVINE, BUDD & Bros (this is a payment on the loan mentioned above), H. McCLELLAN, C. WHEELER, S.A. (or I.A.) ALDREDGE.

It doesn’t look like they settled this estate until 1871. Of the amounts I saw, the largest amount was $3,601.17. In one of the later documents it stated…Amount of M.B. UMPHRIES estate in Confederate Money 827.78…amount of estate in U. S. Currency 131.00. I know this estate was settled after the war…and I am not too familiar with the money exchange.

I have a listing of the land Mitchell B UMPHRESS owned in Jefferson County. It totals approximately 200 acres. The property in AL totals about 40 acres.

I ran across some old Bible records given to me by a dear ALDREDGE lady who in 1996 lived in Grady County. She was 90 years young at the time. The note which was attached to the folder indicated that the information was from an “old” Bible of Jesse M. ALDREDGE and his wife Martha Ann E. UMPHRESS and Mitchell B.’s first wife. The copies are not very good, probably due to the condition of the Bible and/or writing whenever they were made.

It is interesting that son Payton carries the name of the distinguished (Methodist) Rev. Peyton Patrick SMITH, a leader in the Thomasville, GA community and ran the Fletcherville school where MarthaAnn taught.

Mitchell received a land grant (see 1827 Reprint Lottery) that matched that lot, district and section issued to JOHN STOKES heirs in Carroll County.
